Death Penalty Jury selection undermines constitutional promise of a trial by jury

A recent article from the Death Penalty Information Center has reported that a recent report from ACLU has demonstrated that the process of selecting juries for death penalty cases systematically excludes Black prospective jurors, women and people of faith, which subsequently undermines the constitutional promise of a trial by a jury of one’s peers.

The deputy director from the ACLU Capital Punishment Project, Brian Stull has said that “the Constitution guarantees that every person accused of a crime has the right to be tried by a jury of their peers, but that promise is by definition denied for people facing the death penalty.”

The report has highlighted multiple studies which document the discriminatory impact of the death qualification process.
